Terms & Conditions

  1. All prices are subject to the addition of the amount of all taxes applicable to this transaction.
  2. Seller warrants only that the goods will conform to the description. Seller disclaims all other warranties expressed or implied, including but not limited to any warranty of merchantability or fitness for a particular reason. No warranty, express or implied, is offered for custom manufactured material.
  3. If any of the materials fail to conform to the warranty set forth herein, Seller may replace such materials or refund the purchase price therefore, or issue a credit therefore, but shall have no further liability. Claims shall be deemed waived if not made within five (5) days to Seller in writing from the date of receipt of material except that a yield complaint must be made in writing within forty-eight (48) hours after receipt. Seller will not be responsible for consequential or special damages. Unless this receipt is initialed “subject to count” it shall constitute a waiver of any shortage or excess.
  4. Seller shall not be liable for delays from causes beyond its control.
  5. Terms of payment for account holders are net on or before the 10th day of the month following delivery. A service charge of 1 ½% per month, which is an annual rate of 18%, will be added to any balance over 30 days old. In the event it becomes necessary to commence collection proceedings, purchaser agrees to pay all collection costs incurred including reasonable attorney fees.
  6. Any discrepancy in quantity, quality or color of material must be reported to Seller prior to installation or else claim is waived.
  7. Purchaser shall provide suitable roadways or approachways to points of delivery other than on public roadways or alleyways, and will indemnify Seller against all liability, loss and expense incurred, as a result of deliveries beyond the public roadways and alleyways.
  8. All made to order material is nonrefundable. Purchaser is responsible for installing onsite sample mockups and approving material before ordering custom material. If the purchaser believes there is a discrepancy between the sample material and the manufactured product it is the purchaser’s responsibility to notify Seller.
  9. All returned merchandise is subject to a restocking fee. All returned merchandise must be received at the Seller’s place of business, inspected and to be found in a re-saleable condition. In order to receive a refund or credit, merchandise must be returned to the Seller no later than thirty (30) days after the date of the original receipt. Packaged cement products are not returnable after seven (7) days from the date of purchase. THE ORIGINAL RECEIPT MUST ACCOMPANY ALL RETURNS!

FRESHLY MIXED CEMENT, MORTARS, GROUTS AND CONCRETE MAY CAUSE INJURIES, INCLUDING BURNS, TO THE SKIN AND EYES. AVOID CONTACT WITH THE SKIN AND WASH EXPOSED AREAS WITH WATER. IF ANY CEMENT OR CEMENT MIXTURES GET INTO THE EYES, RINSE IMMEDIATELY AND REPEATEDLY WITH CLEAN WATER AND GET PROMPT MEDICAL ATTENTION. THIS WARNING MUST BE CONVEYED TO ALL PERSONS WHO MAY PURCHASE, HANDLE, USE OR COME IN CONTACT WITH CEMENT AND CEMENT MiXTURES.
